Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Pixel•Boy (the "Service"), a browser-based retro arcade operated by Kylie Moore ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Account

You must be of legal age in your jurisdiction to purchase subscriptions or credits. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

2. The Service

Pixel•Boy provides access to a catalogue of arcade-style browser games, subscription tiers (Core and VIP), and one-time credit packs that can be spent to play games. Features, catalogue, and pricing may change over time.

3. Acceptable Use

You must not misuse the Service. In particular, you may not: (a) use the Service unlawfully or for fraud, spam, or abuse; (b) infringe intellectual property or other rights; (c) interfere with the Service's security, probe, scan, or scrape it, or upload malware; (d) attempt to reverse engineer, resell, or redistribute the Service; or (e) circumvent credit, subscription, or technical limits.

4. Intellectual Property

Pixel•Boy, its software, branding, artwork, and content are owned by Kylie Moore or licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial entertainment within your active plan.

5. Payments, Subscriptions & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscription and payment mechanics — including billing frequency, renewals, taxes, cancellations, and refunds — are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period (3, 6, or 12 months, depending on the plan you selected) until cancelled. Credit packs are one-time purchases and non-recurring.

6. Credits

Credits are a virtual in-app currency used to start game sessions. Credits have no monetary value outside the Service, are non-transferable, and are not redeemable for cash except where required by law or where a refund is issued through Paddle.

7. Service Availability

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately; unused credits may be forfeited except where a refund applies.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the amounts you paid to us in the 6 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

10. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Kylie Moore is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
